Real Estate

Property is often a client’s largest commitment. We treat it that way.

From a single commercial unit to a mixed development, we advise buyers, sellers, landowners, developers and occupiers. We know where title, consent and financing issues tend to surface, and we raise them first.

Our property work sits alongside the corporate practice, so that transactions involving companies that own land, or land that sits inside a family structure, are handled as one matter.

01What we advise on

What we advise on

  1. 3.1

    Acquisitions & disposals

Commercial, industrial and residential property, including title investigation, conditions precedent and completion.

Joint development agreements between landowners and developers, and the approvals and milestones behind them.

  3. 3.3

    Leasing

Office, retail and industrial leases and tenancies for landlords and occupiers, including renewals and fit-out.

  4. 3.4

    Title & strata

Title, strata and land matters, including caveats, encumbrances and transfers.

  5. 3.5

    Financing

Acting for borrowers on property-backed financing and the security documents that go with it.

  6. 3.6

    Foreign ownership

The consents and thresholds that apply when foreign individuals or companies acquire property in Malaysia.

02Typical matters

The kind of workwe are asked to do.

These describe situations, not clients. AUREL & TAN is fictional, so there are no real matters, results or client names here — only the shape of the work.

  1. A

A landowner weighing a joint development proposal and wanting to understand the risk if the developer does not deliver.

  2. B

A growing company taking its first substantial office lease and negotiating fit-out, reinstatement and renewal terms.

  3. C

A family selling an inherited property held in several names, some of whom live overseas.

  4. D

An investor acquiring an industrial property where the land-use conditions had to be checked against the intended operations.

03How we approach it

How we approach it

  1. 01

    Title first

We investigate title, conditions and encumbrances before the commercial terms are fixed, not after.

  2. 02

    Honest timetables

Property transactions depend on consents and third parties. We map them at the start and say which dates are realistic.

  3. 03

    Plain summaries

Leases and development agreements are long. Every client receives a short written summary of what they are agreeing to.

05Questions clients ask

Before youask us.

Do you act on residential purchases?

Occasionally — usually for existing private clients, or where a residential property sits within a wider family or corporate matter. Our focus is commercial property.

How are conveyancing fees calculated?

For many conveyancing transactions in Malaysia, fees follow a prescribed scale. We confirm at the outset which elements are scale fees and which are agreed separately, in writing.

What should a tenant check before signing a lease?

Reinstatement obligations, service charges, renewal rights and the landlord’s rights to relocate or redevelop. Our article on commercial leases covers each of these.
