Private Client

Wealth is personal. So is the advice that protects it.

We work with individuals and families on wills, succession and the structures that sit behind a family business. Many of these relationships span decades and generations; we are built for that.

Because family wealth is often held through companies and property, our private client lawyers work closely with the corporate and real estate practices.

01What we advise on

What we advise on

  1. 5.1

    Wills & estate planning

Wills and estate plans that reflect family circumstances, assets in more than one place and the law that applies to each.

  2. 5.2

    Family business succession

Planning who will own and who will run a family business, and putting the documents in place before they are needed.

  3. 5.3

    Trusts & holding structures

Holding companies and trust arrangements that keep family assets together and governed.

  4. 5.4

    Probate & administration

Applying for grants and administering estates, including estates with assets in more than one country.

  5. 5.5

    Powers of attorney

Arrangements for decisions to be made on someone’s behalf when they cannot make them personally.

  6. 5.6

    Family governance

Family constitutions and agreements that set out how family members take part in the business.

02Typical matters

The kind of workwe are asked to do.

These describe situations, not clients. AUREL & TAN is fictional, so there are no real matters, results or client names here — only the shape of the work.

  1. A

A business founder in their sixties planning how ownership and management will pass to the next generation.

  2. B

A family administering an estate that includes shares in a private company and property in two countries.

  3. C

Siblings who jointly own a family business and want to agree what happens if one of them wishes to leave.

  4. D

An individual updating a will after a marriage, a move abroad or the sale of a business.

03How we approach it

How we approach it

  1. 01

    Listen first

Succession is about people before it is about documents. Our first meetings are mostly questions.

  2. 02

    Coordinated with other advisers

We work alongside accountants, tax advisers and trustees so that the plan works as a whole.

  3. 03

    Reviewed over time

We suggest a review whenever circumstances change, and at least every few years.

05Questions clients ask

Before youask us.

Is a will enough for a business owner?

Often it is not. Shares in a private company may be subject to transfer restrictions, and a will alone does not say who will run the business. Succession planning looks at both questions.

Do the same rules apply to every family?

No. In Malaysia, the law that applies to an estate can depend on the deceased’s religion and on where assets are held. We explain at the outset what applies in each case.

How confidential is this work?

Entirely. Private client matters are handled by a small named team, and we agree with each client how, and with whom, we may communicate.
